Please read these Terms of Use ("Terms") carefully before using the Real-Helper: Agent iOS application ("App") or this website (together, the "Service"). By downloading or using the App you agree to be bound by these Terms.
By accessing or using Real-Helper: Agent you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the Service.
Subject to your compliance with these Terms, Real-Helper grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your professional real estate activities as a buyer's agent. All rights not expressly granted are reserved.
Real-Helper: Agent is a client management and communication tool for buyer's agents. The App allows you to manage a client list, maintain in-app chat threads, create and share property records, run digital open house sign-ins, and, with a Pro subscription, access property data from public records. The App can connect with Real-Helper, the buyer-facing home-search app, so that your messages and shared properties appear in your clients' apps.
The Service uses an account system backed by cloud services (such as Firebase) to associate your profile, clients, conversations, and properties with your account. You are responsible for maintaining the security of your device and any authentication methods used to access the Service. We are not responsible for loss of access or data due to device loss, replacement, or operating-system reinstallation.
You agree not to:
You may enter or upload information about yourself, your clients, properties, and open house visitors into the Service. You represent and warrant that you have all necessary rights and permissions to input and use this information, including any required consents from clients and visitors. You remain responsible for complying with your brokerage policies and applicable privacy and marketing laws when using the Service.
The Service integrates data from third-party providers. Your use of that data is subject to the providers' respective terms:
Property data (such as beds, baths, square footage, assessed value, last sale price, and estimated market value) may be sourced from RentCast. This data is deemed reliable but not guaranteed. You should verify any information you rely on through additional sources before advising clients.
When your clients use Real-Helper, the buyer-facing app, your messages and shared properties may appear in their app. Your clients' use of Real-Helper is governed by that app's own Terms of Use and Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. REAL-HELPER DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
ALL PROPERTY DATA, CLIENT INFORMATION, OPEN HOUSE RECORDS, AND OTHER INFORMATION PROVIDED BY THE SERVICE ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE FINANCIAL, LEGAL, OR REAL ESTATE ADVICE. YOU ARE RESPONSIBLE FOR YOUR OWN PROFESSIONAL JUDGMENT AND COMPLIANCE OBLIGATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REAL-HELPER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF CLIENTS, OR LOSS OF PROFITS, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF REAL-HELPER FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO REAL-HELPER FOR THE SERVICE IN THE 3 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Premium features (Real-Helper: Agent Pro) are available via subscription through Apple's App Store. All purchases are processed by Apple and are subject to Apple's terms and conditions. Real-Helper does not store payment card numbers or billing addresses. Refunds are governed by Apple's refund policy.
You can manage or cancel your subscription through your Apple ID account settings on your device. Deleting your account or uninstalling the App does not automatically cancel your subscription.
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law provisions.
